Developments of the Presidential Proclamation 10052’s<\/strong>. As we have started a new bright year, we wanted to give an update on the Summer Work Travel Program. Recent court cases have clarified that the Summer Work Travel Program should continue. Trump\u2019s action to extend the visa ban to March 31 does not change the outcome of the injunction where this was overturned, Embassies have begun reopening for emergency and regular visa interviews, Cosmopolitan WWE remains active to send our exchange visitors to the USA next summer.<\/p>\n\n\n\n

Timeline and the developments of the Presidential Proclamation 10052’s (Suspending the entry of J-1 Exchange Visitors)<\/strong><\/p>\n\n\n\n

June 22, 2020<\/strong>
The Trump Administration issues a proclamation suspending the entry of J-1 Exchange Visitors to the United States<\/span><\/span><\/strong><\/mark><\/a> from June 24, 2020 to December 31, 2020. 

October 1, 2020<\/strong>
The U.S. District Court in the Northern District of California issued an <\/span>injunction<\/span><\/strong><\/span><\/mark><\/a> <\/span><\/span><\/span>that blocked further implementation of the June 22nd Presidential Proclamation, which had suspended entry into the U.S. of several J-1 Visa Categories.

November 18, 2020<\/strong>
The U.S. District Court in the Northern District of California issued a clarification<\/span><\/strong><\/mark><\/span><\/a> <\/span><\/span>of the injunction<\/span><\/span><\/span><\/strong><\/mark><\/a>. The key points within the clarification state that the government must \u201cinquire whether [an] entity is a member\u201d of one of the plaintiff organizations at the time of the \u201capplication or interview.<\/p>\n\n\n\n


November 20, 2020<\/strong>
in response to the clarification order, the U.S. Department of State issued guidance<\/span><\/a> <\/span><\/strong><\/mark>on implementation of the injunction. This guidance gives J-1 visas Tier 2 priority (similar to petition-based work visas like H and L visas).

<\/p>\n\n\n\n

Developments of the Presidential Proclamation 10052’s<\/em><\/strong> December 31, 2020<\/strong><\/h4>\n\n\n\n

President Trump on Thursday extended an order suspending<\/span><\/span><\/mark><\/strong><\/a> the issuance of certain types of work visas for another three months, citing the ongoing effects of the coronavirus pandemic.<\/p>\n\n\n\n

However this action to extend proclamation 10014 does not change the outcome of the injunction that blocked further implementation issued on October 1st where this was overturned for Summer Work & Travel<\/a><\/span>, Camp Counselor<\/a><\/span><\/span><\/strong>, and Internship-Trainee Program<\/a><\/span><\/span><\/mark><\/strong>.<\/p>\n\n\n\n
